HARIANEXPRESS – The Indonesian Consumer Protection Agency (LPK-RI) is challenging the planned auction of collateral by KSP Surya Abadi Mandiri, scheduled for September 28, 2026, while a legal dispute remains ongoing, (1/9/2026)
The planned auction concerns land and buildings owned by Darul Fuadi, located in Desa Pikatan, Wonodadi, Blitar. The property, approximately 674 m², is set to be auctioned through KPKNL Malang.
The auction carries a limit price of Rp277.802.240, with a required guarantee of Rp55.560.500. This action faces consumer objections due to an ongoing legal dispute that has reached the appeal stage.
Sirait, Chairman of LPK-RI Tulungagung Branch, stated that the organization is aware of the auction plan concerning Darul Fuadi and KSP Surya Abadi Mandiri.
“The case between the consumer and KSP Surya Abadi is still ongoing in court and has now entered the appeal process. Therefore, we ask all parties to respect the legal process that is currently underway,” said Sirait.
He clarified that LPK-RI does not claim all auctions during ongoing cases are impossible, but rather calls for a thorough review of procedures.
“We are not saying that every auction, when a case is still ongoing, automatically cannot be carried out. What we ask is that all its bases and procedures be carefully examined, including by considering the existence of a case still in the appeal process,” he explained.
Moh. Iskandar, Chairman of LPK-RI Blitar Branch, confirmed that his branch is assisting Darul Fuadi in this matter.
“The consumer is pursuing legal action. Therefore, we ask that the consumer’s rights continue to be respected and that the entire process be conducted transparently and based on valid documents and legal provisions,” said Iskandar.
Iskandar emphasized that their assistance does not negate the consumer’s obligations.
“This assistance does not mean the consumer rejects their obligations. We want to ensure that the collection process and actions against the collateral object are carried out according to procedure and do not harm the consumer,” he asserted.
LPK-RI Blitar is prepared to support Darul Fuadi in filing a complaint with the Blitar Police if harmful actions are suspected. This step aims to ensure consumer protection and legal certainty.
“We will accompany the consumer to submit a complaint to the police if there are alleged actions that harm the consumer. We fully submit to law enforcement officials to conduct an examination and assess based on existing evidence,” said Iskandar.
LPK-RI urges KSP Surya Abadi Mandiri, KPKNL, and other related parties to ensure all auction stages comply with legal regulations. They also ask that the pending appeal case be considered throughout the process.
“We hope this issue can be resolved objectively through legal mechanisms. No party should be disadvantaged due to a process that is not carried out carefully,” concluded Sirait.
LPK-RI will continue monitoring the case and the planned auction of the collateral object.
